The Law of Ukraine “On Environmental Audit” defines the basic legal and organizational principles of conducting an environmental audit, which is designed to increase the environmental validity and efficiency of enterprises regardless of the form of ownership and type of activity.

According to the law, an environmental audit is a documented, systematic, independent process of evaluating the object of an environmental audit, which includes the collection and objective evaluation of evidence to establish the compliance of specified types of activities, measures, conditions, the system of environmental management and information on these issues with the requirements of the legislation of Ukraine on environmental protection and other environmental audit criteria.

The goals and objectives of the environmental audit:

• Justification and initiation of environmental activities.
• Analysis and assessment of environmental aspects of the enterprise.
• Analysis and evaluation of regulatory acts in the field of environmental protection.
• Justification and initiation of environmental activities.
• Identification of environmental problems of industries and territories.

According to the Law of Ukraine “On Environmental Audit”, two types of audit are provided:

Voluntary – carried out at the initiative of the object’s management or in agreement with it, if a third interested party (client, financial institution, etc.) acts as the Audit Client.

Mandatory – it is carried out by order of interested government bodies for facilities or activities that pose an increased environmental hazard.

Mandatory environmental audit in Ukraine is carried out in the following cases:

• Bankruptcy of the enterprise.
• Privatization.
• Concessions of state and communal property objects.
• Transfer or acquisition of an enterprise into state or communal ownership.
• Transfers of state or communal property for long-term lease.
• Creation of joint ventures based on state and communal property.
• Environmental insurance of objects.
• Completion of the product distribution agreement in accordance with the law.
• In other cases provided by law.
